A NASCAR team owner has been arrested on suspicion of DUI at an Atlanta speedway.
Billy Ballew was arrested Wednesday at the Atlanta Motor Speedway. He reportedly was carrying a mixed drink when he was pulled over and refused to take a breathalyzer test.
Ballew told a reporter that he believes he’ll beat his DUI charge because his arrest occurred on private property - at the Speedway - but a prosecutor said Georgia law doesn’t distinguish between public and private property when it comes to drunk driving.
Some drivers refuse a breath or blood test after a DUI arrest because they hope it will help them avoid a drunk driving conviction, but prosecutors can typically use a chemical test refusal as evidence of ‘consciousness of guilt,’ meaning that the driver wouldn’t have refused unless he or she knew it was impossible to pass.
Also, in many states, a refusal can be charged as a separate criminal offense. Most reputable DUI lawyers advise their clients against refusing a chemical test after a drunk driving arrest.
