Tips for Hiring a DWI Attorney

Saturday, May 31st, 2008

DWI, which stands for Driving While Intoxicated, is a serious crime. Therefore, the person charged with this type of crime needs a good DWI attorney, someone who understands current DWI laws. Before choosing just any attorney, the person should meet with two or three attorneys in person for a preliminary overview of the case. A reputable DWI attorney would be willing to sit down and answer everything. Some of the questions the attorney will likely ask include the number of offenses the driver has had, the state in which the offense occurred, any injuries, deaths, or damages related to the case, and so on. With this information, the attorney will be able to decide whether he or she will accept the case or turn it over to someone else. An attorney working a DWI case needs to have the right experience, and licensing to handle such a case.

Choosing DUI Lawyers

Saturday, May 24th, 2008

DUI lawyers are professional attorneys who work in prosecuting or defending a driver charged with driving under the influence, whether the substance involves alcohol or drugs. For someone who has been arrested for driving while intoxicated, the first thing he or she will need to do is to find a lawyer, even if the driver is guilty of the offense. By law, the person in this case would be deemed innocent in a court of law until proven guilty. Therefore, DUI lawyers will work from this standpoint. Sometimes, the law enforcement officer who did the arrest may have overlooked something important that could reduce or eliminate the charge. An attorney will be able to find these small loopholes to benefit the driver. In addition, a person convicted of drunk or drug driving can often received a more lenient sentence with a high quality attorney to fight for his or her case.

Understanding DUI Laws

Wednesday, May 21st, 2008

When it comes to DUI laws, each state will have its own legal parameters. There are many factors involved in determining DUI, which could mean a serious crime on a federal level, resulting in jail or prison time, or a warning with probation and community service. Today, DUI laws are much stricter than they have ever been.  Since many innocent lives have been compromised by DUI incidents, prompting harsher penalties and enforcement of DUI, it is expected that DUI laws will continue to be stricter, and new laws will be established to keep drunk drivers off the roads.

Comprehending DUI Law

Saturday, May 17th, 2008

Most people associate DUI law with driving while drinking, but this also involves driving while on drugs. A DUI can be prosecuted much the same way whether alcohol or drugs are involved. This type of charge is very serious, and in most states, carries a serious punishment. When charged, the person should look for an attorney who understands DUI law. With this knowledge, the attorney can determine whether the driver met the legal definition of driving under the influence. Laws for DUI will vary for each state. In some states, the driver who has a measurable level of narcotics in the system is considered to have committed DUI, whereas in other states, there is no legal limit. In all cases, this is a serious crime that can have serious consequences. If you feel you have been wrongly charged with DUI, consider hiring a DUI attorney to fight your case.

Elements for Driving While Intoxicated

Monday, May 12th, 2008

Driving while intoxicated is a serious crime in most states. However, the elements of the defense will depend on a number of factors to include the driver’s past criminal history, whether anyone was injured or killed, and even the prosecutor and defense attorney’s abilities. Of course, elements associated with driving while intoxicated also depend on the state in which the incident occurred. For instance, some states will look at the person’s impairment, which is based on blood alcohol content or BAC of .08 or more, and coupled with other elements. In some states, just one element is used for prosecution. In all states, driving while drunk is illegal. Charges for driving under the influence will vary, depending on the level of the impairment and degree of damages.

What is Driving under the Influence?

Wednesday, May 7th, 2008

Simply put, when a person drinks and then gets behind the wheel of a vehicle, he or she is driving under the influence. Some states term this as “driving while intoxicated,” which means the same thing. Driving under the influence can also mean driving while on drugs. Because there are so many serious dangers associated with this type of crime, new laws have been created in each state. Many times, the person is sentenced to time in jail, but there are many factors involved that would be looked at by the judge. The bottom line is that driving while drinking or taking drugs is not only against the law, but dangerous and too often fatal. While most people think this only pertains to automobiles, these laws also apply to boats, motorcycles, bicycles, and in some jurisdictions, horses.

Understanding Colorado DUI

Friday, May 2nd, 2008

While a DUI is a serious crime in all states, the laws vary from one state to the next. For instance, a Colorado DUI would be different from a Missouri or Texas DUI. In this state, punishment is available for two different types of cases; one being from the Division of Motor Vehicles and the other, through the court system. With a Colorado DUI, anyone charged has seven days from the date of arrest to request a formal hearing with the DMV. If the request is not made, the driver’s license is automatically suspended. In addition, the Colorado Department of Revenue also requires a hearing within 60 days of the arrest. The person’s license will stay in good standing until the outcome of that hearing is complete. There are many laws, each state with its own, which is why for a DUI or DWI, a person needs an attorney who knows the law.
